RECOMMENDATION
title

BACKGROUND AND ANALYSIS
On May 25, 2023, Engineering staff was notified of a potential slope failure adjacent to the Northerly Street storm drain, which is a City facility located within an easement on private property. CIP Engineering and Inspection staff, along with the City’s geotechnical consultant, visited the site and determined the slope damage was caused by the failure of a corrugated metal drainage pipe (CMP).
The geotechnical consultant determined that the slope remained stable enough to avoid emergency repairs; however, future repairs would be necessary to prevent further damages. Staff advertised informal bids for in-kind repairs of the pipe and slope, focusing on containing and repairing the existing damage. Proposed costs submitted through the informal bid process exceeded the City’s anticipated estimate. The bids also did not propose a strong solution to prevent future maintenance issues.
Given that the slope was stable, staff employed a different approach to address the required repairs and protect City resources. Staff utilized existing on-call contracts to procure professional engineering services that would analyze the area and provide full construction documents to complete the work, including relevant drainage studies and calculations. With the new approach, the City had dual objectives to not just repair the damage, but also to provide a long-lasting drainage solution that provides easier access for conducting future maintenance.
The proposed project includes abandoning the existing CMP pipe, backfilling it with a slurry mix, and repairing the damaged slope. To address drainage and enhance access to the facility for maintenance purposes, the proposed project would realign existing storm drains along Northerly Street into a new reinforced concrete pipe (RCP) that would run through the City’s existing easement.
On June 27, 2024, Engineering staff publicly advertised the Northerly Slope Repair project. Staff solicited bids by formally advertising the project in accordance with the City’s standard formal bidding procedures.
On July 24, 2024, three bids were received and publicly opened. Staff analyzed the bids and determined that the lowest bid of $548,880 from Blue Pacific was the most responsible and most responsive to the bid advertisement, thereby qualifying the firm for the project award. The bid results are included as Attachment 3.
FISCAL IMPACT
Staff is requesting to use the American Rescue Plan Act (ARPA) Storm Drain Projects Account 837172621271.5703 to cover the costs associated with Blue Pacific’s PWA for the Northerly Slope Repair project.

CITY ATTORNEY’S ANALYSIS
The bid documents were previously reviewed by the City Attorney and approved as to form. The contract must be awarded to the lowest responsive and responsible bidder. A “responsive bidder” is a bidder who has responded to all requirements of the bid request; the Public Contract Code defines “responsible bidder” as a bidder who has demonstrated the attributes of trustworthiness as well as quality, fitness, capacity and experience to satisfactorily perform a public works contract.
