TITLE:  INTRODUCTION OF AN ORDINANCE AMENDING SECTION 19.2(d) OF THE OCEANSIDE CITY CODE TO ESTABLISH CONSISTENT FIRE RING USAGE HOURS ON ALL PORTIONS OF THE OCEANSIDE BEACH

RECOMMENDATION

title

Staff recommends the City Council introduce an ordinance amending Section 19.2 (d) of the Oceanside City Code, to establish consistent fire ring usage hours on all portions of the Oceanside Beach.

body

BACKGROUND AND ANALYSIS

Section 19.2(d) of the Oceanside City Code currently prohibits the use of fire rings on Oceanside Beach between the hours of 11:00 p.m. and 6:00 a.m., every day of the week. However, this restriction currently only applies to areas of the beach between Breakwater Way and Wisconsin Street (i.e., areas along The Strand). The purpose of this City Code amendment is to establish consistent fire ring usage hours for all segments of Oceanside’s beaches by eliminating the Code language that specifically applies the hourly restrictions only to those portions of the beach along The Strand.  Eliminating this language would ensure that the 11:00 p.m. to 6:00 a.m. prohibition applies to all City beaches, including Harbor Beach which currently has no hourly restrictions in place.

Once adopted, the proposed ordinance amending Chapter 19.2(d) will require staff to post signs along Harbor Beach notifying beach goers of permitted fire ring usage hours and allow the City to uniformly enforce restrictions for all Oceanside beaches.

FISCAL IMPACT

The installation of the proposed signs would cost approximately $150 per sign.  Two signs will be posted at Harbor Beach, the total amount of $300 will be charged to Harbor Maintenance account 600627101.5355 which has an available balance of $8,975; therefore, sufficient funds are available.
