RECOMMENDATION

Staff recommends that the City Council approve Amendment 3 to a Performance of Services Agreement with NetFile Inc., in annual amount of $15,000 for a total contract amount of $219,000 to provide software and maintenance services to support the electronic filing system of Campaign Disclosure Statements and Statements of Economic Interest (SEI), extending the term of the agreement from January 22, 2026 through January 22, 2027; and authorize the City Manager to execute the amendment.

BACKGROUND AND ANALYSIS
On January 22, 2014, the City entered into a Performance of Services Agreement (Attachment 2) with NetFile Inc., in an annual amount of $18,000 to provide software and maintenance services to support the electronic filing system of Campaign Disclosure Statements and Statements of Economic Interest (SEI). Since the adoption of the City’s Ordinance No. 14-OR0050-1, requiring online or electronic filing of Campaign Disclosure Statements and Statements of Economic Interest reports, candidates, political action committees and designated positions in the City have complied with the filing requirements. The City Clerk serves as the filing official/officer for the Fair Political Practices Commission (FPPC) for these forms.
On February 6, 2019, Council approved Amendment 1 to the Performance of Services Agreement in the amount of $18,000 annually for a two-year extension.
On December 15, 2021, Council approved Amendment 2 extending the Performance of Services Agreement for an additional four years.
In July 2012, the California Legislature approved Assembly Bill 2452, which authorizes local jurisdictions to require the filing of campaign statements and reports solely in an electronic format. NetFile is a vendor approved by the California Secretary of State to provide an online electronic filing system for both campaign disclosure statements and SEI forms.
NetFile software is designed for the Web, which provides quick access and a simple user experience. Campaign treasurers and SEl filers simply enter their information into the system and can then print disclosure reports and/or file those reports electronically. There is no financial burden to the filers. The data and reports are hosted on NetFile servers. The data is secured and is replicated to offsite locations for redundancy. The cost of the program includes ongoing support, maintenance and training, all provided by NetFile.
FISCAL IMPACT
The annual cost of NetFile is $15,000, to be charged to the Elections account 120123101.5355.0009, which has a current balance of $290.312, therefore sufficient funds are available.
