RECOMMENDATION
title
Staff recommends that the City Council approve Amendment 2 to the Professional Services Agreement (PSA) with Marine Taxonomic Services (MTS), Ltd., in the amount of $50,972, for a total contract amount not to exceed $117,205, for analytical services to meet the requirements of the National Pollutant Discharge Elimination System (NPDES) permit; and authorize the City Manager, or designee, to execute the amendment.
body
BACKGROUND AND ANALYSIS
The City is subject to the waste discharge requirements (WDRs) set forth in the NPDES permit Order No. R9-2019-0166. As a discharger to the Pacific Ocean, the City must adhere to the permit requirements to monitor specific sites around the ocean outfall discharge point. The Ocean Outfall line begins just north of the mouth of the Loma Alta Creek and east of South Pacific Street. The pipeline extends southwesterly approximately
8,850 feet offshore to a depth of approximately 100 feet. This is the point where the secondary-treated wastewater and waste brine is discharged to the Pacific Ocean. This scope of work includes the sampling and analysis for toxic, physical and chemical properties of sediment, and the state of benthic, fish and invertebrate communities.
On October 9, 2024, a PSA with MTS was executed to perform Ocean Outfall Inspection and Maintenance Services. On December 10, 2024, Amendment 1 of the agreement was executed administratively to include additional ocean monitoring requirements of the NPDES permit, specifically the sediment and benthic community assessment, fish and invertebrate trawl collection, rig fishing, and reporting services. Amendment 2 addresses the laboratory services needed to analyze the specimens and sediment samples acquired in the scope of work in Amendment 1. Council approval is required on this amendment because the new contract maximum will exceed $100,000.
Amendments to this contract will impact agencies with a capacity share of the Ocean Outfall, including Camp Pendleton, Rainbow Municipal Water District, and Genentech.
FISCAL IMPACT
Amendment 2 will be funded from the Sewer Laboratory Account, 800806721.5305, which has a current available balance of $65,505; therefore, sufficient funds are available.
