BACKGROUND AND ANALYSIS

In April 2011, California Legislature and Governor Brown passed Assembly Bill 109 (AB109) which resulted in fundamental changes to California’s correctional system, and gave responsibility for lower-level offenders and parolees from the state to local jurisdictions. AB109 has several key components. The first allows for non-violent, non-serious, and non-sex offenders to be supervised at the local county level after they are released from prison. A second component to the bill diverts defendants convicted of less serious felony crimes such to serve their time in a local county jail rather than in state prison. Once released from custody, and back into our community, offenders are then to report to County probation officers instead of reporting to state parole officers.

The San Diego County Sheriff’s Department received funds from the Community Corrections Partnership (CCP) to create the R3G to support CCP’s public safety goal. The multi-agency group will use the funds to develop and implement a targeted, proactive, intelligence-based approach to control and counteract the risks associated with realigned offenders released into San Diego County. The County’s Board of Supervisors approved and authorized the Sheriff’s Department to execute expenditure contracts to use the funds to reimburse all participating agencies for overtime expenses incurred in R3G activities.

In support of the R3G mission, law enforcement agencies will provide enhanced enforcement by increasing presence in areas where offenders are known to reside and frequent, and in jurisdictions where they have been released. The presence will include fourth waiver searches, probation compliance checks, and coordinated multi-agency sweeps. The agreement was initially effective, with annual allocations, from July 1, 2017 through June 30, 2022. Since the conclusion of that original performance period, the R3G project has been extended from July 1, 2023 to June 30, 2026 per available County funding. The fiscal year 2026-27 extension is the fifth-year extension of the original Memorandum of Understanding (MOU) with the County. The County shall have the option to renew this agreement for successive one-year increments beyond June 30, 2027, subject to available funding.

The Sheriff’s Department has received funding for the 2026 R3G, and will distribute the allocated funds to each participating party upon request. The Oceanside Police Department (OPD) has been allocated $65,000 for overtime activity. OPD will use the funds for overtime details to support of the R3G mission, with the primary goal of enhancing public safety. OPD will complete reimbursement forms no later than the final business day of the subsequent month from the claimed month.

FISCAL IMPACT

The San Diego County Sheriff’s Department will reimburse the City of Oceanside for approved expenses up to $65,000. Staff requests an appropriation of $65,000 to the 2026 R3G accounts listed below. There are no fund matching requirements for the City.
