TITLE: AMENDMENT 3 TO THE PROFESSIONAL SERVICES AGREEMENT WITH DOKKEN ENGINEERING FOR THE CLEVELAND STORM DRAIN UPGRADE PROJECT

Staff recommends that the City Council approve Amendment 3 to the Professional Services Agreement (PSA) with Dokken Engineering (“Dokken”), in the amount of $95,475 for a total contract amount not to exceed $1,126,703, for additional engineering design services for the Cleveland Storm Drain Upgrade Project (“Cleveland Storm Drain”); and authorize the City Manager to execute the amendment.

BACKGROUND AND ANALYSIS
The City’s current Master Plan of Drainage (MPD) identifies areas throughout the City where additional storm drain infrastructure would provide greater protection. Due to the potential impact of flooding to residential and commercial properties, the Cleveland Storm Drain Upgrade project is identified in the MPD as a top priority project. The project consists of design, hydrologic and hydraulic analysis, and construction of reinforced concrete storm drain pipes and appurtenances along Cleveland Street from Seagaze Drive to Surfrider Way. The project objective is to upgrade the system to comply with the MPD’s recommendations and current design standards.
On October 18, 2017, the City Council approved a PSA with Dokken in the amount of $586,578, for engineering consulting services for the proposed Cleveland Storm Drain Upgrade project.
On May 22, 2019, the City Council approved Amendment 1 to the PSA with Dokken in the amount of $243,670, for the proposed project. Amendment 1 decreased the scope of work for construction surveying, and increased the scope of work for design survey, geotechnical engineering, potholing, utility locating, and design for sewer and water improvements of Surfrider and Seagaze Drive.
On June 26, 2024, the City Council approved Amendment 2 to the PSA with Dokken in the amount of $200,980, for the project. Amendment 2 increased the scope to conduct additional analysis of the outfall structure and re-design the sewer lateral in order to reduce construction costs.
Progression of the final design has been delayed by regulatory agency review, including coordination with the California Coastal Commission. The project experienced extended review periods related to ongoing agency coordination.
To advance the project and streamline the approval process, the design was modified to remove elements requiring Coastal Commission approval, reducing permitting risk and schedule impacts. As a result of these modifications, additional hydraulic analysis of the outfall structure and redesign of the storm drain connection at Surfrider Way and the Strand are required. In addition, the project plans are based on survey data collected in 2018. Due to the extended project duration, changing site conditions, and staffing constraints, portions of the existing survey information are now outdated and require additional surveying efforts to support completion of the final design.
Amendment 3 to the PSA with Dokken will provide for the additional surveying, updates to the storm drain design and hydraulic analysis associated with the outfall structure, and preparation of final plans, specifications, and bid documents necessary to advertise the project for construction.
Staff anticipates advertising the project for construction bids by the end of 2026 and returning to City Council in spring 2027 for award of the construction contract.
FISCAL IMPACT
Amendment 3 is in the amount of $95,475 and will be charged to the Cleveland Storm Drain Upgrade account 905150217516.5703.10600, which has an available balance of $750,000therefore, sufficient funds are available.
