Staff recommends that the City Council approve Amendment 1 to the Professional Services Agreement (PSA) with KTU&A, in the amount of $8,066 for a revised contract total of $473,650, for additional investigatory services regarding the former Maxon Street Landfill at Ron Ortega Park for the Dog Park; appropriate $8,066 in funds from the Parks Fee Fund; and authorize the City Manager to execute the amendment.

BACKGROUND AND ANALYSIS
On March 22, 2023, the City Council awarded a PSA to KTU&A in the amount of $465,584 for the design of a dog park at Ron Ortega Park.
The planned facility is located on the site of the former Maxson Street Landfill, which requires special consideration in the design and construction process.
During a community outreach meeting held on November 8, 2023, residents requested the inclusion of shade amenities, either by trees or shade structures, along with other site improvements. In response to this input, the design consultant was directed to conduct a geotechnical investigation to verify the landfill’s cover depth. This investigation was necessary to determine the feasibility and constructability of the proposed requested improvements before the design is presented again for community feedback.
In June 2024, City staff reached out to the Regional Water Quality Control Board (RWQCB) to seek approval for the proposed boring plan associated with the geotechnical investigation. In August 2024, the RWQCB notified the City that approval would be contingent on the City’s Public Works Department first reviewing and approving the boring plan. Public Works subsequently requested revisions to the plan to also include location information for all gas-related infrastructure within the closed landfill, as well as the proposed approach to investigating landfill gas appurtenances and determining depth of cover.
To address these requirements, City staff collaborated with KTU&A to prepare a contract amendment proposal. However, the original geotechnical subconsultant declined to proceed with the work, which presented additional delays to the project. As a result, KTU&A began coordinating with alternative geotechnical firms and its landfill subconsultant, SCS Engineers, to identify another lower-risk approach to gather the required data.
The revised methodology would determine precise locations and depths of the existing buried landfill gas (LFG) collection system, involving the use of a GPS-enabled inspection camera system to locate buried gas laterals and document pipe depths to the extent feasible. The design consultant will translate the GPS data to produce an exhibit of the subsurface piping investigation.
Once the investigation is complete and boring locations are determined, City staff will be able to initiate the geotechnical investigation, including the boring plan to determine the landfill’s depth of cover.
FISCAL IMPACT
Amendment 1 with KTU&A is $8,066 and will be charged to the Dog Facilities Design CIP account. Staff is requesting to use $8,066 from Parks Fees Fund reserves and appropriate to account 906165220598.5305. The funding source is Park Fees Fund assigned fund balance account 598.3020 which has a current available balance of $9.4M; therefore, sufficient funds are available.
