Request by Councilmember Figueroa and Deputy Mayor Joyce to direct staff to draft a resolution that ensures City of Oceanside policies and practices do not support or contribute to federal immigration enforcement, and that promotes public awareness of Oceanside residents’ due process rights under the Constitution.
1. The City will actively disseminate “Know Your Rights” information (including a website).
2. Prohibit federal law enforcement personnel from immigration enforcement in non-public areas of City-owned or City-controlled properties without a judicial warrant.
3. Future City contracts to include clauses prohibiting contractors from disclosing sensitive, personal, or non-public information to federal immigration enforcement agencies. Unless otherwise required by state and federal law.
4. Sensitive or personal data collected by the City will not be shared with immigration enforcement agencies, directly or indirectly. Unless otherwise required by state and federal law.
5. Direct staff to publish official procedures for Oceanside Police Department when responding to calls for mutual aid of any federal agency conducting immigration enforcement.
6. Direct staff to publish an official statement following calls for mutual aid.
7. Direct City to designate neighborhood resource centers as support centers for Day Laborers and Street Vendors to provide support with the lawful submission of vending permit applications.
8. Direct City to allocate funding for fiscal year 2025-2026 to a selected (CBO) to administer Crisis relief case management and basic needs stabilization.
9. Direct the City to create a plan for filing a Freedom of Information Act (FOIA) request with the FOIA office on behalf of the City, when requested by the immediate family of a person who has been detained or deported within the City of Oceanside.
