BACKGROUND AND ANALYSIS

The City has received a request from Au Energy, LLC, owner of the property located at Seagate Way (Parcel 13 of Parcel Map No. 20077), proposing the vacation of a portion of water and sewer line easement located on their property. This portion of easement described in Exhibit "A" and shown in Exhibit "B" was granted per Map No. 20077, recorded as Instrument No. 2006-0577840 recorded August 14, 2006, in the Office of County Recorder of San Diego County.
The area to be vacated is described in Exhibit "A" and shown on Exhibit "B", attached hereon.
The existing water lines in this easement have been relocated. Replacement water lines have been constructed as part of grading plan G23-00007.
The Water Utilities Department has reviewed and confirmed that there are no other public facilities in the area to be vacated and the easement is no longer required and it does not object to the vacation.
California Streets and Highways Code, section ?8333 (c) provides the City Council with the authority to summarily vacate public service easements provided they have been superseded by relocation or determined to be excess by the easement holder, and there are no other public facilities located within the easement.
