TITLE: AMENDMENT 1 TO THE PROFESSIONAL SERVICES AGREEMENT WITH KTU&A FOR INVESTIGATORY SERVICES RELATED TO THE PROPOSED RON ORTEGA DOG PARK

Staff recommends that the City Council approve Amendment 1 to the Professional Services Agreement (PSA) with KTU&A, in the amount of $8,066 for a revised contract total of $473,650, for additional investigatory services regarding the former Maxon Street Landfill at Ron Ortega Park for the Dog Park; appropriate $8,066 in funds from the Parks Fee Fund; and authorize the City Manager to execute the amendment.

BACKGROUND AND ANALYSIS
On March 22, 2023, the City Council awarded a PSA to KTU&A in the amount of $465,584 for the design of a dog park at Ron Ortega Park.
The planned facility is located on the site of the former Maxson Street Landfill, which requires special consideration in the design and construction process.
During a community outreach meeting held on November 8, 2023, residents requested the inclusion of shade amenities, either by trees or shade structures, along with other site improvements. In response to this input, the design consultant was directed to conduct a geotechnical investigation to verify the landfill's cover depth. This investigation was necessary to determine the feasibility and constructability of the proposed requested improvements before the design is presented again for community feedback.
In June 2024, City staff reached out to the Regional Water Quality Control Board (RWQCB) to seek approval for the proposed boring plan associated with the geotechnical investigation. In August 2024, the RWQCB notified the City that approval would be contingent on the City's Public Works Department first reviewing and approving the boring plan.
